Terms and Conditions

1. Acceptance and scope

These Terms and Conditions are issued by Nixon Solutions LLC, doing business as Tactical Grooming, of 105 Church St, Suite E, Madison, AL 35758.

They apply to your use of our websites, our booking system, our customer portals, our text message program, our grooming services, the products sold under Tactical Grooming Supplies, our loyalty, rewards, membership and referral programs, and the other GROW connected services we operate.

By booking an appointment, buying a product, creating an account, enrolling in a program, or using one of our websites, you agree to these terms as they apply to what you are doing.

Use of our text message program is also governed by our SMS terms at https://sms.tgsbarber.com, which form part of these terms. Our handling of personal information is described in our Privacy Policy at https://privacy.tgsbarber.com.

2. Eligibility and your information

You must give us accurate and current information when you book, buy or create an account, and keep it up to date.

You must be authorised to use the telephone number, email address and payment method you give us. Do not enter somebody else's mobile number into our forms. Consent to receive messages can only be given by the person who uses the number.

If your telephone number changes, update it with us or in your portal account, so that messages intended for you do not reach somebody else.

3. Appointments and grooming services

Appointment availability is not guaranteed. A requested time is confirmed only when we confirm it.

Please arrive on time. Arriving late shortens the time available for your service, because the appointment after yours belongs to somebody else.

Cancellations and reschedules require at least 24 hours notice, unless we have published a different requirement for a particular service or program. Late cancellations and missed appointments may incur a fee, and repeated occurrences may affect your ability to book online.

Prices may change. The price that applies is the price shown at the time you book or buy.

Any service duration we show is an estimate. Hair, beards and skin differ, and results vary from person to person. We will tell you before we start if what you have asked for is not achievable safely on your hair.

Tactical Grooming may refuse, cancel, reschedule, suspend or discontinue a service for legitimate reasons, subject to applicable law. Those reasons include safety concerns, inappropriate or disruptive behaviour, violation of our shop policies, nonpayment, suspected fraud, scheduling limitations, staffing limitations, an inability to perform the requested service safely, and health or sanitation concerns.

Nothing in these terms creates an absolute obligation on us to provide or continue providing any particular service to any person. We apply these terms consistently and lawfully, and we do not refuse service on any basis prohibited by law.

4. Products and Tactical Grooming Supplies

We try to describe our products accurately, but descriptions, images and packaging may vary, and small differences in colour, scent and consistency are normal for products of this kind.

Prices and availability may change without notice, and products may sell out. Your order is an offer to buy. We accept it when we confirm it or dispatch it, and we may decline an order or cancel it before dispatch, for example where an item is out of stock, a price was shown in error, or we suspect fraud.

By placing an order you authorise us or our payment provider to charge the payment method you supply for the total shown, including any applicable taxes and shipping.

Where we ship, delivery estimates are estimates. Delays caused by carriers, weather or events outside our control are not within our control.

Tell us promptly if an order arrives damaged, defective or incorrect, and we will put it right. The returns section below explains how.

You are responsible for using products as directed. Read the label. Our products are cosmetic grooming products, they are not medicines, and we make no medical claims about them. They are not intended to diagnose, treat, cure or prevent any condition.

If you have allergies or sensitive skin, check the ingredients before use and patch test first. Stop using a product if you react to it, and seek medical advice if you need it.

Promotional codes and discounts have their own conditions, cannot be combined unless we say so, have no cash value, and may be withdrawn or corrected if used in error or obtained improperly.

Our products are sold for personal use. Purchase for commercial resale is not permitted without our written agreement.

5. Returns and refunds

Because grooming products are personal use items, beard oils, beard butters, washes, fragrances, clearance items, promotional items and samples may be final sale.

If an online order arrives damaged, defective or incorrect, tell us within seven days of delivery. We may ask for reasonable documentation, such as a photograph of the item and the packaging, so that we can resolve it and raise it with the carrier or supplier where needed.

For an in store concern, bring the item to the shop with proof of purchase where you have it.

Depending on the circumstances, an appropriate resolution may be a replacement, store credit, a refund, or another remedy we agree with you.

Where a prepaid service is cancelled by Tactical Grooming and not rescheduled, the amount paid for it is refundable.

Nothing in this section limits any refund or remedy you are entitled to under applicable law, and nothing here asks you to give up a legal right that cannot be waived.

6. Accounts and the customer portal

You are responsible for keeping your account credentials confidential and for activity that happens under your account. Tell us promptly if you believe somebody else has accessed it.

Keep your account information accurate. We rely on it to reach you about appointments and orders.

We may suspend or close an account for the legitimate reasons described in these terms, including suspected fraud, abuse, or misuse of our systems.

Our portals and websites may be unavailable at times, for maintenance or for reasons outside our control. We do not guarantee uninterrupted or error free service.

7. Loyalty, rewards, memberships, referrals and promotions

We run customer programs from time to time. Each has its own published rules, and those rules govern that program.

• Program rules vary between programs and may differ from these general terms
• Eligibility requirements apply, and some programs are limited to particular customers, services or periods
• Rewards, points and credits have no cash value unless we expressly state otherwise
• Rewards issued in error may be corrected, adjusted or removed
• Fraud, abuse or manipulation of a program may result in forfeiture of rewards and removal from the program
• Program terms, benefits and reward values may change, and a program may be ended
• Individual promotions may carry additional terms, which are published with the promotion
• Expiration of rewards follows the published rules of the program that issued them

Where a program includes text message benefits, taking part in the program does not by itself opt you into marketing messages. Message consent is always collected separately.

8. Reviews, photographs and other things you send us

You may choose to send us reviews, feedback, photographs or other material. You do not have to, and nothing depends on it.

What you send stays yours. We do not claim ownership of it.

By sending it to us in connection with our services, you give us permission to use, display, reproduce and adapt it for the limited purpose of showing our work and operating our business, including on our websites, our portfolio and our social media accounts. That permission covers only material you have submitted or agreed we may publish, and only the uses reasonably needed for those purposes.

You confirm that you have the right to send us what you send, and that it does not infringe anybody else's rights.

You can ask us to stop using something you sent us, and we will do so going forward, within a reasonable period. Material already printed or distributed offline may not be recoverable.

We may decline to publish, or may remove, anything we consider unlawful, offensive, misleading or otherwise unsuitable.

9. Intellectual property

The Tactical Grooming and Tactical Grooming Supplies names, logos, marks and trade dress, the GROW platform and its component programs, and applicable Zero Hour Works branding, are the property of their respective owners.

The content of our websites and systems, including code, text, graphics, photographs, layout, design and written material, is owned by us or licensed to us and is protected by copyright and other laws.

You may view and use our websites for their intended purpose. You may not copy, reproduce, republish, scrape, resell or create derivative works from our content or code without our written permission, other than as applicable law permits.

10. Third party services

We use other companies to provide parts of what you see. Payment processing, booking, messaging, delivery and authentication are examples.

Those services operate under their own terms and their own privacy policies. When you use one of them, whether through a link or embedded in our pages, that company's terms apply to that part of the transaction.

We are not responsible for the content, availability or practices of services we do not control.

11. Disclaimers

We provide our services with reasonable skill and care, by licensed professionals, and we stand behind our work.

Grooming results depend on your hair, your skin, your growth pattern and how you maintain the result at home. We cannot guarantee a particular outcome, and outcomes vary.

Our grooming services and products are cosmetic. They are not medical treatment, they are not a substitute for medical advice, and they are not intended to diagnose, treat, cure or prevent any condition. Speak to a healthcare professional about a scalp or skin condition.

Our websites, portals and software are provided on an as is and as available basis. To the extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non infringement in respect of those online services.

Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

12. Limitation of liability

To the maximum extent permitted by applicable law, Tactical Grooming is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data or loss of goodwill, arising out of or relating to your use of our websites, systems, services or products.

To the maximum extent permitted by applicable law, our total liability arising out of or relating to a particular service, order or transaction is limited to the amount you paid us for it.

These limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that applicable law does not permit us to limit.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold Tactical Grooming harmless from third party claims, losses and reasonable costs, including reasonable legal fees, that arise from your breach of these terms, your misuse of our services or systems, your violation of applicable law, or your infringement of somebody else's rights.

This does not apply to the extent a claim arises from our own negligence or wrongdoing, and it does not require you to cover anything applicable law does not permit us to shift to you.

We will tell you promptly about any claim we expect you to cover, and we will not settle it in a way that creates an obligation for you without your agreement.

14. Governing law and venue

These terms are governed by the laws of the State of Alabama, without regard to its conflict of laws rules.

The intended venue for any dispute is a court of competent jurisdiction located in Madison County, Alabama, and both you and we consent to the jurisdiction of those courts, subject to applicable law.

Nothing here removes a right you may have to bring a claim in a small claims court, or any other right under applicable law that cannot be waived by agreement.

Please raise a dispute with us directly first, in writing, using the contact details below. Most things are quicker to fix that way.

15. Changes to these terms

We may update these terms. The current version is always published at https://terms.tgsbarber.com with its effective date shown at the top of the page.

Changes apply from the date they are posted. Where a change materially affects an existing booking, order or program you are already part of, the terms in force when you entered into it continue to apply to that transaction.
